This section of the WiCollab Privacy Policy is addressed to users located in the European Union.

This WiCollab Privacy Policy governs the collection, storage and use of your personal data as user of the WiCollab App (the “App“), by us, Inspectron. It provides you with details about the personal data we collect from you, how we use it and your rights to control personal data we hold about you. Any future updates will be communicated to you via email.

All terms which are capitalized but not otherwise defined herein have the meaning ascribed to it in the WiCollab Terms and Conditions.

  1. Who we are:

Inspectron Inc. is a company organised under the laws of the United States having its registered office at 29108 Lorie Lane, Wixom, MI 48393, United States (“Inspectron” or “we“). Our permanent representative in the European Union is Inspectron SRL, a company organised under the laws of Belgium having its registered offices at 475, avenue Louise, 1050 Brussels.

As data controller, we respect your right to privacy and will only process personal data you provide to us in accordance with applicable data protection laws and as described in this policy. Applicable data protection laws mean applicable laws relating to or impacting on the processing of personal data of a living person and privacy and may include, as the case may be, the General Data Protection Regulation (European Regulation 2016/679) (“GDPR”).

  1. The personal data we collect about you and the purposes for which we collect it:

You will be requested to provide the following personal data to Inspectron for using the App: first name, last name and email address. If you have subscribed to a Subscription Plan purchased from us or from one of our official distributors (“the Vendor“) to be able to use our Wi Cloud Services (as further defined in the WiCollab Terms and Conditions), additional data that you associate with pictures or recordings when using our products, such as metadata, will also be stored on the Wi Cloud.

Where applicable, we may receive the abovementioned information from the Vendor from whom you purchased the Subscription Plan, as well as additional information strictly relating to your Subscription Plan (e.g. date of signature of the contract, type of Subscription Plan purchased, number of users, etc.).

We always process your personal data on the basis of and within the boundaries of the legal bases as those are laid down under applicable law. We also ensure to limit the processing of your personal data to what is strictly necessary for the achievement and performance of these purposes.

We process the abovementioned categories of personal data because this is necessary for the performance of the Agreement concluded with you (i.e. the WiCollab Terms and Conditions). We process your personal data for the purposes of (i) the registration of your WiCollab Account and/or User Account and the Products linked to your WiCollab Account and/or User Account, (ii) to enable you to update and/or upgrade the firmware stored on the Products or to inform you about available updates and/or upgrades of the App, (iii) to provide you with support services and (iv) to provide you, where applicable, the Wi Cloud Services.

You will not be able to use the App if we cannot process the abovementioned personal data.

When not strictly necessary for any of the abovementioned reasons, we may also process your personal data for other purposes, falling under the achievement and the realisation of our legitimate interests. In particular, Inspectron uses your personal data for promoting its goods and services, such as promoting accessories, connected tools and/or additional or new services.

In such a case, however, Inspectron maintains a fair balance between the need to process your data and the preservation of your rights and freedoms, including the protection of your privacy. Whenever this is the case, Inspectron will keep you informed about what type of legitimate interest we are pursuing and provide you with transparent information about the processing operations and your rights.

Against this background, we may process your personal data to ensure the security of the App and to notify you of any changes to the Terms and Conditions or this Privacy Policy.

  1. How we share your personal data and who we share it with

3.1 Principle

We will not sell, rent or otherwise disclose your personal data to any third party, except as described in this Policy.

3.2 Recipients

We may provide your personal data to our affiliate Inspectron SRL (with registered office at Avenue Louise, 475, 1050 Brussels, Belgium) and to third-party processors (such as Inspectron’s IT and cloud services providers) to process personal data on our behalf for the purposes set out above. These parties are required to process such information based on our instructions and in accordance with this policy.

Please note that, when your User Account is linked to a WiCollab Account, the WiCollab Account owner has access to the personal data contained in your User Account and may share your Uploaded Data (incl. personal data linked to it) with all the User Accounts linked to said WiCollab Account. Said personal data include your name, surname and details about your use of our products. See, for more information, our WiCollab T&Cs.

3.3 Compliance with laws and legal proceedings

We may disclose your personal data:

– where we are required to do so by applicable law, by a governmental body or by a law enforcement agency;

– to establish or exercise our legal rights or defend against legal claims; and

– to investigate, prevent or take actions against illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms and Conditions, or as otherwise required by law.

  1. How long do we keep your personal data?

We will hold your personal data as long as we deem it necessary to provide you with our services. Should you no longer use the App and wish that the personal data that we hold about you be erased, you may request the deletion of your WiCollab Account and/or User Account (incl. the personal data linked to your WiCollab Account and/or User Account) at any given time by emailing us at Customerservice@inspectrontools.com

Should you no longer use the Wi Cloud Services, we will automatically erase your personal data related to it after sixty days after the end of the Subscription Plan you entered into with us or our official distributor.

In any case, if your personal data are no longer required for the performance of our services to you or if you have requested the deletion of your WiCollab Account and/or User Account, we will delete the personal data that we hold about you unless their further processing is necessary to comply with our legal obligations (including bookkeeping and tax obligations, as the case may be) or to resolve disputes and/or enforce our agreements (i.e. for the preservation of evidence within the scope of statutes of limitations).

  1. International transfers

In connection with the abovementioned purposes, we try to avoid as much as possible the transfer of personal data that we collect from you to recipients located in third countries.

When we transfer personal data that we collect from you to recipients located in countries that are outside of the European Economic Area and which do not offer an adequate level of protection, we ensure the use of appropriate data transfer tools under the GDPR such as the entering into of the standard contractual clauses issued by the European Commission.

We take appropriate technical and organisational measures to safeguard the personal data that you provide to us against unauthorized or unlawful processing and against accidental destruction, loss or damage.

  1. Your rights

Under the GDPR, you have the following rights as a data subject:

  1. a) the right to access to personal data that we hold about you;
  2. b) the right to ask us to update or correct any out-of-date or incorrect personal data that we hold about you;
  3. c) where the processing is based on your consent, the right to withdraw consent at any given time, without affecting the lawfulness of processing based on consent before its withdrawal;
  4. d) the right to erasure where the conditions of article 17 of the GDPR have been met;
  5. e) the right to restriction of processing where the conditions of article 18 of the GDPR have been met;
  6. f) the right to data portability insofar the conditions of article 20 GDPR apply to you;
  7. g) the right to object to processing of personal data concerning you, insofar the conditions under article 21 GDPR have been met.
